Conclusion of the Contract and Terms of the Contract

2.1 The contract is concluded upon the Schlossresidenz’s acceptance of the guest’s booking request. The operator is free to confirm the booking in writing, electronically, or in any other written form.

2.2 The terms of the contract are governed by the booking confirmation, the booked rate, any expressly confirmed individual agreements, and these General Terms and Conditions in the version in effect at the time of booking.

2.3 Individual agreements take precedence over these Terms and Conditions, provided they have been expressly confirmed in writing by the operator.

2.4 The guest making the reservation is required to provide all information essential to the reservation—in particular, the names, number, and ages of all guests arriving at the property—in a complete and truthful manner. The guest must also ensure that these Terms and Conditions and the house rules are observed by fellow travelers and visitors and is liable to the extent provided by law for their conduct.

3. prices and terms of payment

3.1 Unless expressly stated otherwise, the agreed prices include the applicable statutory value added tax.

3.2 If the period between the conclusion of the contract and its performance exceeds four months and the price generally charged by the operator for comparable services increases, the operator may raise the agreed-upon price by a reasonable amount, but by no more than 8%. Statutory rights to adjust prices and obligations to provide information remain unaffected.

3.3 The operator’s invoices are payable in full within 7 days of receipt, unless a different due date is specified in the booking confirmation, the booked rate, or on the invoice.

3.4 To secure a reservation, the operator may require an advance payment. This payment will be credited in full toward the agreed-upon total price.

3.5 The operator is entitled to require a reasonable advance payment or security deposit upon conclusion of the contract or thereafter, particularly in the case of extended stays, high-value bookings, special requests regarding use, or a justified need for security.

3.6 If the guest defaults on a payment that is due, the statutory consequences of default shall apply. The operator may withhold further services until full payment is made, to the extent permitted by law and reasonable for the guest.

4. Check-in, Check-out, and Use in Accordance with the Contract

4.1 Check-in begins at 3:00 p.m., and check-out must be completed by 10:30 a.m. at the latest. Early check-ins or late check-outs require prior approval and may be subject to additional charges.

4.2 The premises provided may be used only by the persons listed in the booking confirmation and authorized by the operator, and exclusively for the agreed-upon purpose of lodging.

4.3 The guest agrees to treat the provided accommodations, furnishings, the castle grounds, and all facilities with care, and to comply with the house rules, safety guidelines, and legitimate instructions of the operator.

4.4 Quiet hours are from 9:00 p.m. to 6:00 a.m. During this time, guests must refrain from making noise or engaging in behavior that could disturb other guests, local residents, or the operation of the facility.

4.5 Excessive use of the premises or facilities, use that violates the terms of the contract, or use that is atypical for an accommodation facility is prohibited. This applies in particular to unauthorized gatherings, the regular care of third parties, commercial activities, and use as a workplace with a continuous flow of visitors or customers.

5. Adult Center and Minors Accompanied by Adults

5.1 The Schlossresidenz is intentionally designed as a quiet retreat for adults. Bookings, accommodations, and stays are strictly reserved for adults 18 years of age or older.

5.2 Without exception, the transportation, accommodation, or other hosting of minors requires the operator’s prior express consent in writing. There is no entitlement to such consent.

5.3 If, contrary to Section 5.2, a minor is brought along without prior notice or is admitted during the stay, the operator is entitled to refuse admission or accommodation and to demand the immediate termination of that person’s unauthorized stay.

5.4 Instead of a rejection or immediate termination, the operator may, at its sole discretion and on an exceptional basis, grant retroactive consent subject to a fee. For each minor admitted retroactively, an additional flat fee of €70 per day of stay (or portion thereof) will be charged, unless a different amount is specified in the booking confirmation or a current price list provided prior to the conclusion of the contract. Mere tolerance in an individual case does not constitute grounds for a claim to further tolerance nor does it constitute a change to the adult-only residence concept.

5.5 Consent to admit a minor does not automatically imply consent to admit other children, accompanying persons, caregivers, family members, or visitors.

5.6 The guest remains responsible for the supervision, safety, and conduct of any minors who accompany the guest or whom the guest has invited. The Schlossresidenz assumes no responsibility for the care or supervision of such minors.

6. Visitors, Day Guests, and Additional Guests

6.1 Visitors, day guests, caregivers, family members, acquaintances, and other individuals not listed in the booking confirmation may not enter or use the apartments, suites, common areas, the castle park, or other facilities only with the operator’s prior express consent.

6.2 Consent is required regardless of whether the person in question is staying overnight, is only visiting temporarily, is visiting a guest, is caring for children, is working, is consuming food or beverages, or is using other facilities. This also applies to additional persons and children accompanying visitors.

6.3 The operator may, on a case-by-case basis, permit brief drop-offs or pickups in the entrance or reception area. This does not entitle anyone to access apartments, suites, common areas, the castle park, or other facilities.

6.4 The operator may make approval contingent upon availability, the operating concept, safety considerations, the number of people, the length of stay, and the payment of a visitor fee or a flat fee for additional persons. There is no entitlement to approval.

6.5 A flat fee of €70 per visitor per calendar day will be charged for each approved additional visitor or day guest, unless a different price has been expressly agreed upon in advance. This fee covers only the approved stay as specifically agreed upon; meals, the sauna, special facilities, and other additional services are included only if this has been expressly confirmed.

6.6 If unregistered guests are found on the premises without prior consent, the operator may require them to leave the accommodation and the property immediately. Alternatively, the operator may, at its sole discretion, grant retroactive consent subject to a fee in accordance with Section 6.5. Retroactive payment does not entitle the guest to further or future use of the property.

6.7 If a person who has not made a reservation stays overnight, or if it is determined that the accommodation was actually used, a flat rate of at least €70 per person per night—the rate applicable to additional guests—may be charged. Further claims, in particular those arising from additional costs or damages, remain unaffected; any expenses saved shall be offset to the extent required by law.

6.8 The guest making the reservation is responsible for ensuring that their visitors and guests comply with these Terms and Conditions and the house rules. The guest is liable for any damages and additional costs caused by them in accordance with applicable law.

6.9 The apartments and suites are intended exclusively for lodging. Use for childcare, daycare, supervision of minors, or similar care purposes is prohibited without the operator’s prior express consent.

6.10 The operator is entitled to refuse entry to or terminate the stay of additional persons if, based on an objective assessment, this could impair the character of the adult retreat, the peace and quiet, the safety, the privacy of other guests, or the proper operation of the hotel.

7. Income from renting the property to another party and expenses saved will be taken into account.

8. Breakfast and Additional Services

8.1 Whether breakfast is included in the reservation or charged separately is determined solely by the booking confirmation or the rate selected.

8.2 Changes to the breakfast plan apply exclusively to reservations made after the respective change was implemented, unless otherwise expressly agreed.

8.3 Additional services that guests select, book, or pay for on their own at the location using a QR code, payment link, terminal, or similar self-service systems are considered to have been bindingly ordered.

8.4 Subsequent cancellation or refund of additional services that were properly and intentionally ordered is not permitted, unless a statutory right of withdrawal, rescission, reduction, or refund applies.

8.5 If the guest accidentally books or pays again for a service that is already included in their rate, the transaction will not be automatically reversed. Upon notification from the guest, the operator will review the transaction on a case-by-case basis and make a correction provided that double billing is objectively confirmed and no additional service has already been used.

9. Smoking, Pet, and Safety Rules

9.1 The Palace Residence is a smoke-free building. Smoking, including the use of e-cigarettes, vaporizers, and similar products, is prohibited in all indoor areas.

9.2 Pets are not permitted in the apartments and suites. Exceptions require the operator’s prior express written consent.

9.3 Charging large or non-household lithium-ion batteries—in particular those for e-bikes, e-scooters, or similar vehicles—is prohibited in apartments, suites, and in emergency exits, unless the operator provides a specifically designated charging area or has previously approved an exception.

9.4 Open flames, candles, incense sticks, cooking appliances outside designated kitchen areas, and other sources of increased fire risk are prohibited.

9.5 If a guest violates smoking, pet, or safety rules, the operator may demand that the guest cease such conduct, remove the animal or item, and reimburse the operator for the actual costs incurred for special cleaning, odor neutralization, repairs, or lost revenue. The guest reserves the right to prove that no damage occurred or that the damage was less than claimed.

10. Use of the Castle Park and Its Facilities

10.1 The castle park and the facilities of the castle residence are available exclusively to guests with reservations and to visitors who have been expressly authorized, within the scope of their respective authorizations.

10.2 Use of the facility must be in accordance with the published hours of operation, intended uses, and safety rules. The operator may temporarily close individual areas for operational, weather-related, safety-related, or organizational reasons, provided that this does not unreasonably impair the primary service provided under the contract.

10.3 Events, as well as photography and video recordings that go beyond purely private use—in particular, commercial shoots, content productions, influencer productions, and advertising or editorial shoots—require the operator’s prior express consent in writing.

10.4 Authorized photography and filming will be billed as follows:

Private photo shoots:
– in the castle park: 200 €
– indoors and outdoors at the castle residence: 400 €

Commercial photo and video shoots:
– half-day (up to 4 hours): 400 €
– full-day (up to 8 hours): 700 €

Additional Services:
– Use of suites or interior spaces for indoor shoots: €150 per hour
– Provision of electrical outlets or other infrastructure: based on actual costs / upon request

10.5 In the event of unauthorized photography or filming, the operator may demand that such activities cease immediately, that the person involved leave the areas in use, and, in the case of significant or repeated violations, that the person’s visit be terminated. Alternatively, the operator may, at its sole discretion, grant retroactive permission subject to a fee under the terms set forth above. Any further claims, particularly those arising from additional use, damages, or legal violations, remain unaffected.

10.6 Drones and other unmanned aerial vehicles may be operated on the property only with the operator’s prior express consent and in compliance with all legal requirements.

11. Keys, Inventory, Damage, and Exceptional Soiling

11.1 The guest must keep keys, access cards, codes, and other means of access in a safe place and protect them from access by third parties. Any loss or misuse must be reported immediately.

11.2 A replacement fee of €15 may be charged for a lost or damaged room key. If, for security reasons, locks, cylinders, access systems, or codes must be replaced or reconfigured, the operator may charge the actual, documented costs incurred for this. The guest reserves the right to prove that no damage occurred or that the damage was less than the amount claimed.

11.3 The guest is liable, in accordance with statutory provisions, for any damage culpably caused by the guest, the guest’s traveling companions, visitors, or any other persons to whom the guest has granted access.

11.4 Any damage, malfunctions, losses, or unusual soiling must be reported immediately. The operator may demand compensation in accordance with statutory provisions for costs of cleaning, odor neutralization, disposal, repair, or replacement that exceed the usual extent, as well as for any verifiable loss of rental income resulting therefrom.

12. Wi-Fi and Other Technical Equipment

12.1 To the extent that the operator provides Wi-Fi or other technical facilities free of charge, subject to the booking confirmation, there is no entitlement to a specific transmission speed, constant availability, or suitability for a particular purpose.

12.2 The guest may use the Internet access only in accordance with applicable laws. In particular, the following are prohibited: illegal downloads, the distribution of illegal content, interference with systems or networks, and the infringement of copyrights, personal rights, or other rights of third parties.

12.3 Login credentials must not be disclosed to unauthorized third parties. The guest must notify the operator immediately if he or she suspects any misuse.

13. Operator Liability and Items Brought onto the Premises

13.1 The operator bears unlimited liability for damages resulting from injury to life, limb, or health that are attributable to an intentional or negligent breach of duty by the operator, its legal representatives, or its agents. The operator is also liable without limitation for other damages resulting from willful misconduct or gross negligence, as well as in cases of liability mandated by law.

13.2 In the event of a breach of a material contractual obligation due to slight negligence—the fulfillment of which is essential for the proper performance of the contract and on the observance of which the guest may reasonably rely—liability shall be limited to foreseeable damages typical for this type of contract.

13.3 In all other respects, the operator’s liability for damages caused by slight negligence is excluded to the extent permitted by law.

13.4 The statutory provisions apply to items brought in by the guest, in particular the provisions regarding the innkeeper’s liability. Guests are asked to store valuables and personal documents in the safes provided and to report any loss immediately.

13.5 The operator is liable for vehicles and any items inside them only to the extent required by law. The provision of a parking space does not constitute a contract of safekeeping unless expressly agreed upon.

14. Billing and Changes to Invoices

14.1 Invoices are generally sent electronically to the email address provided at the time of booking.

14.2 For bookings made through booking platforms, notification sent to the email address on file with the platform or to a forwarding address provided by the platform shall be deemed to have been properly delivered, unless the guest has provided a different address in a timely manner.

14.3 The guest is required to provide the desired billing information completely and accurately at the time of booking.

14.4 Upon a justified request, the operator will provide a copy of the invoice again. For repeated requests or additional manual work, a reasonable processing fee—which has been communicated in advance—may be charged, provided that the guest caused the additional work and there is no legal obligation to process the request free of charge.

14.5 Subsequent changes to billing addresses or other billing information are permitted only to the extent that they are permissible under tax law and in practice. If such changes result in significant additional work caused by the guest, the operator may charge a reasonable processing fee, the amount of which must be communicated in advance.

14.6 There is no entitlement to immediate processing or repeated revisions. The guest’s statutory rights remain unaffected.

15. Special Services and Administrative Expenses

15.1 For exceptional additional organizational services not included in the agreed-upon main service, the operator may demand reasonable compensation, which must be communicated prior to the assignment.

15.2 This applies in particular to:

subsequent, legally permissible changes to billing addresses or billing information,

repeated requests for documents already sent,

Manual processing of independently triggered postings or payments,

individualized support for self-check-in or self-service processes, to the extent that such support goes beyond the standard support provided,

Repeated processing of the same transaction at the guest’s express request.

15.3 No fee will be charged if the processing is necessary to fulfill the operator’s legal obligations or to correct an error for which the operator is responsible.

16. Obligations to Cooperate and Reporting of Complaints

16.1 The guest is required to immediately report any apparent defects, complaints, or discrepancies from the agreed-upon booking services to the operator or the appropriate staff during the stay.

16.2 The guest must give the operator a reasonable opportunity to investigate the matter and, to the extent possible and reasonable, to remedy it.

16.3 If the guest fails to report the issue through his or her own fault, he or she may not assert any claims that could have been avoided by taking appropriate remedial action had the issue been reported in a timely manner. Statutory rights that cannot be waived remain unaffected.

16.4 Complaints filed after departure will be reviewed. To the extent that a resolution or remedy would have been objectively possible during the stay had the complaint been reported in a timely manner, this must be taken into account in the legal assessment of the claims asserted.

16.5 Subjective impressions, personal preferences, or individual expectations do not in and of themselves constitute a defect. This applies in particular to personal assessments of location, style, decor, atmosphere, design, ambiance, or the breakfast concept, provided that the objectively agreed-upon quality and services were provided.

16.6 Features and conditions of the accommodation that were clearly communicated in the booking details, on the website, on booking portals, in images, descriptions, or location information are an integral part of the basis of the booking. This does not apply to misleading, inaccurate, or incomplete information.

16.7 Public reviews, subsequent complaints via email, or notifications through booking portals do not replace a timely report of defects during the stay, provided that such a report was possible and reasonable for the guest to make.

17. House Rules, Breaches of Duty, and Termination of Stay

17.1 The operator exercises the right to enforce house rules throughout the entire property and in all buildings.

17.2 In the event of violations of these Terms and Conditions, the house rules, safety regulations, or legitimate instructions, the operator may initially demand that the violation cease and that corrective action be taken within a reasonable period of time appropriate to the circumstances. In the event of serious violations, hazards, misrepresentation of the number of people present, unauthorized admission of minors or visitors, persistent disturbance of the peace, unlawful conduct, or repeated breaches of duty, it may not be necessary to set a prior deadline.

17.3 The operator may remove unauthorized persons from the premises at any time and prohibit them from entering in the future.

17.4 In the event of good cause, the operator may terminate the lodging agreement for cause in accordance with statutory provisions and demand immediate vacating of the premises. Any further claims, in particular for payment of fees already due and compensation for damages caused through negligence, remain unaffected. The operator must allow for any savings in expenses and income from alternative rentals, to the extent required by law.

17.5 Any tolerance, goodwill, or exception granted on a case-by-case basis does not constitute a permanent waiver of the relevant rights and does not establish a claim to equal treatment in future cases.

18. Data Protection and Self-Check-In

18.1 Personal data is processed in accordance with applicable data protection regulations and the operator’s privacy policy.

18.2 The guest is required to provide complete and accurate information during the booking and self-check-in process and to provide only the information of those traveling companions for whom the guest is authorized to disclose such information.

18.3 If the registration information or proof of identity required by law is not provided in full, the operator may refuse to check in the passenger until the passenger has complied with the requirements.

19. Final Provisions

19.1 For evidentiary purposes, any amendments or additions to this Agreement must be made in writing. Individual agreements shall take precedence, regardless of their form, to the extent provided by law.

19.2 For consumers, the statutory places of jurisdiction apply. If the guest is a merchant, a legal entity under public law, or a special fund under public law, Hanover shall be the exclusive place of jurisdiction—to the extent permitted by law. The same applies if the guest does not have a general place of jurisdiction within Germany and a corresponding agreement on the place of jurisdiction is permitted by law.

19.3 The law of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods. With respect to consumers, this choice of law shall apply only to the extent that it does not deprive them of the protection afforded by mandatory provisions of the country of their habitual residence.

19.4 Should any provision of these Terms and Conditions be or become invalid, in whole or in part, the validity of the remaining provisions shall remain unaffected.
